Terms and Conditions

By Booking and using the Services, You accept and agree to be bound by these terms and conditions. The terms and conditions can be updated at any time and any changes will take effect immediately. It is Your responsibility to read and keep up to date with the latest terms and conditions.


Definitions
‘You’ /’Your’                 The person engaging the Trainer’s Services
‘Trainer’                       Ali Creighton, the owner of Doodle Dogs
‘Dog’ The dog for which the Services are being provided
‘Consultation Form’  The form provided by the Trainer and completed by You to request the Services
‘Services’                     The services provided by the Trainer in the course of her business as a dog training instructor
‘Session’ The time during which the Services are delivered
‘Booking’ The reservation of a Session
‘GDPR’ General Data Protection Regulations

Booking
1 A Booking is confirmed once the Consultation Form has been completed and returned to the Trainer and payment has been received in full by the Trainer. The Session will not go ahead without the completion and supply to the Trainer of the Consultation Form.

Venue
2 The Services will be provided at a location advised by the Trainer when You make a Booking and this location could be indoor or outdoor, in a private or public location or at your own home and is subject to change.
3 Outdoor classes will go ahead in cool or showery weather and You are responsible for dressing yourself and your dog appropriately. If You choose not to attend a Session due to the weather, You will not receive a refund.
4 If the Trainer considers the weather conditions too adverse for outdoor training, the Session may be moved to an indoor venue, postponed or cancelled at the Trainer’s discretion. You will be refunded the cost of the Session in the event of any such cancellation.

Services
5 The Trainer will deliver the Services using positive, force-free training methods.
6 The Services provided are specific to the Dog. They are not designed for, and should not be used for any other dogs without prior consultation with the Trainer regarding their relevance. 
7 The Trainer reserves the right, at the Trainer’s absolute discretion, not to provide the Services to:
7.1 any dog that the Trainer considers a danger to any person or any other animal
7.2 any unvaccinated dog
7.3 any breed banned under the Dangerous Dogs Act 1991
7.4 any dog or person that disrupts a group class to the detriment of any other attendee
7.5 any dog or person at the absolute discretion of the Trainer for reasons including by not limited to safety or insurance

You
8 You will:
8.1 complete the Consultation Form accurately and honestly. The Trainer accepts no responsibility for matters not disclosed on the Consultation Form.
8.2 inform the Trainer before any Session of any changes or updates to the information previously provided in the Consultation Form including but not limited to: medical information, dog behavioural changes, homing situation or ownership of the Dog and legal matters relating to the Dog for example a Court order.
8.3 not request Services if the Dog is subject to the Dangerous Dog Act 1991, is subject to a Court Order or is not lawfully in your care.
8.4 ensure the Dog has a well-fitted and secure flat collar or harness with an ID tag.
8.5 ensure the Dog is microchipped.
8.6 keep yourself, your family and visitors, and the Dog safe. The Trainer is not responsible for injuries or damage to You, the Dog or personal property.
8.7 keep the Dog on a lead during any Session unless agreed with the Trainer.
8.8 prevent the Dog coming into contact with any other dog during any Session.
8.9 keep the Dog under control during any Session. Failure to do so and any injury caused by the Dog being out of control will be Your full responsibility.
8.10 ensure the Dog wears a well-fitting muzzle for the Session if the Dog is known to bite other dogs or humans. The Trainer takes no responsibility for dogs not muzzled or not kept under control during the Session or when outside of the Session. Failure to wear a muzzle when asked may result in the immediate termination of Services.
8.11 be responsible for all Vet bills, no matter how they are incurred.
8.12 bring any recommended equipment advised by the Trainer to the Session
8.13 comply with the Trainer’s instructions including not using any aversive techniques or equipment on the Dog. If you use forceful handling methods, punishment or aversive equipment your Session will be terminated and you will not be offered a refund. Aversive equipment includes but is not limited to: slip leads, choke chains, prong collars, electric collars, correction sprays, rattle cans.
8.14 follow the safety measures put in place by the Trainer. In the event of a pandemic or similar event including but not limited to bringing your own equipment or receiving the Session over a video conference call such as Zoom.
8.15 inform the Trainer before the Session if you have tested positive for Covid-19 on the day of the Session or in the 5 days prior to the Session.
8.16 remove any dog faeces passed by the Dog at the Venue and dispose of them responsibly.
8.17 not knowingly bring the Dog to group training if the Dog is known to be reactive to dogs or people.
8.18 fully engage with the process of working with the Dog to the best of your ability.
8.19 understand that training involves commitment and consistency and that there is no ‘quick fix’ when working with training or behaviour issues.
8.20 ask for clarification of anything which is explained in unclear
8.21 have an open mind with regard to potential solutions, changes and strategies

Weather
9 Sessions may be held outdoors, and terrain may be uneven and slippery in places.
10 It is Your responsibility to dress appropriately for the weather conditions and wear appropriate footwear.
11 The Trainer will decide whether or not Sessions go ahead depending on the weather.
12 Sesions will not be cancelled due to mildly inclement weather including rain. If you choose not to attend such sessions You will not be offered a refund.
13 Sessions will be re-located, postponed or cancelled in extreme weather conditions (even at short notice). If the Session is cancelled, You will be offered a refund.

Health & Vaccinations
14 The Dog must be fully vaccinated with the usual annual vaccinations (or have a suitable titre test result) and be on a regular preventative regime for internal and external parasites. You will provide proof of vaccinations upon request. You are fully responsible for the good health and timely vaccination status of the Dog and will seek professional medical assistance from your veterinarian in this regard if necessary. The Trainer is not qualified to provide any medical or vaccination advice. 
15 You will advise the Trainer in advance of any Session if the Dog has contracted or been in contact with another dog infected by a contagious disease or if they appear to be unwell (eg. vomiting, diarrhoea, coughing, runny nose etc) in which case the Dog may not be allowed to attend the Session.
16 The Trainer accepts no responsibility for the potential or actual exposure of the Dog to any disease or pathogen.
17 It is Your responsibility to advise the Trainer if the Dog has any known allergies or intolerances to certain foods or has any other special needs.
18 Bitches in season are not to attend any group Session.
19 In the case of behavioural issues, You permit the Trainer to contact your vet on your behalf and to have access to the Dog’s veterinary records and to discuss such records with your vet.
20 It is your responsibility to obtain a vet check for the Dog if this is recommended by the Trainer.

Privacy
21 The Trainer respects Your privacy in accordance with the GDPR and You confirm that you respect the privacy of the Trainer. You agree that you will not share training and behavioural materials provided to You as part of the Services to any other persons, apart from immediate family members and for sole use with the Dog.
22 The Trainer collects information from and about You and the Dog for the sole purpose of providing the Services and may disclose this information to others as is necessary for the provision of the Services. This includes but is not limited to veterinarians with whom the Trainer would be reasonably expected to share information in the provision of Services. The Trainer shall accept no liability for any loss or inconvenience suffered by any party as a result of such disclosure of such information. 

Children
23 Children over the age of 12 are welcome to attend a Sessions but must be accompanied and supervised by an appropriate adult at all times.
24 It is the responsibility of the supervising adult to ensure the child/children’s safety at all times and the Trainer accepts no responsibility for children who attend Sessions.
25 If a child’s behaviour disrupts the class or poses difficulties for any of the dogs, the Trainer may request their removal.

Marketing/Social Media
26 Photographs may occasionally be taken during Sessions and used by the Trainer for the purposes of marketing.
27 If you do not want photographs of You and/or the Dog to be used or shared, please advise the Trainer in writing.
28 If you do not want the Dog’s name to be used or shared, please advise the Trainer in writing.
29 Your name will never be used or shared without your permission.
30 You are not permitted to film any part of any Session.

Disclaimer
31 The Trainer is not qualified to provide veterinary, nutritional or legal advice and the information provided is not intended to constitute such.
32 Comments and advice provided by others on social media or elsewhere may not be endorsed by the Trainer and should be treated accordingly.
33 By making a booking with the Trainer, You accept that participating in an activity with dogs, children and adults poses a risk of injury to yourself and the Dog, and you indemnify the Trainer for all personal injury and damage to the Dog and any property while attending a Session.
34 You accept full responsibility for any risks, injuries or damages, known or unknown, which occur as a result of Your Dog attending a Session.
35 You will make any person who accompanies you to a Session, or takes Your place, aware of these terms and conditions and that they are also there at their own risk.
36 You understand and accept that the Dog (and its behaviour) remains entirely Your responsibility at all times, whether or not in the presence of the Trainer.
37 The Trainer takes no responsibility for misinterpretation of advice. Many external factors influence behaviours and the Trainer cannot guarantee that its training advice will be successful without controlling all of these other factors. You will ask the Trainer for clarification if you are unsure about any advice.
38 The Trainer takes no responsibility for behaviour of the Dog outside of a Session.
39 The Trainer strongly recommends You have third party liability cover for the Dog.
40 The Trainer accepts no responsibility for loss of, or injury to, the Dog whilst in a Session.
41 A veterinary behaviour consultation is recommended for behavioural problems. Animal aggression can cause injury and/or fatalities. Treatment for aggression is not a guarantee of success and modifying behaviour does not assure the aggression will be successfully controlled. It is Your responsibility to ensure safety of people and other animals with regards to the Dog. Safety precautions will be advised and may include; limited access to people/animals, being kept on lead, wearing a muzzle, use of gates around the home and other behavioural modification management strategies.

Fees & Payment
42 Fees are as set out in my written communication with You and are quoted for the Dog. VAT is not chargeable.
43 Fees are exclusive of any out-of-pocket expenses. Any such expenses will be agreed with you in advance of being incurred.
44 Travel expenses (both ways) will be charged for travel to locations in excess of 10 kilometres from Bathford at a rate of 45p per mile.
45 Parking expenses will be charged if necessary for home visits.
46 A session is secured by making full payment and a Session can be changed, postponed or cancelled any time before full payment is made.
47 Payment is required in full at least 48 hours before the Session.  If payment is not received in full, the Session may be cancelled.

Cancellations
48 The Trainer does not offer refunds for cancelled Sessions or missed Sessions unless in exceptional circumstances, to be decided at the Trainer’s absolute discretion.
49 If You wish to rearrange an individual Session, You must provide at least 48 hours notice to the Trainer. Failure to do so may result in the Session being cancelled without refund.
50 Once a course has begun no refund is available as your place can no longer be filled.
51 The Trainer reserves the right to cancel any Session (at any time and with immediate effect) if the Dog does not respond well to the training plan and You will be offered a refund in such circumstances.
52 The Trainer reserves the right to cancel a booked Session at any time at its absolute discretion including but not limited to unforeseen circumstances, including due to the implications of a pandemic.  

Safety
53 Any accidents or injury sustained during a Session must be reported to the Trainer immediately but such notification does not constitute responsibility by the Trainer.

Complaints
54 Please direct any complaints to the Trainer. These are viewed as an opportunity for improvement and are welcomed.

Governing Law & Jurisdiction
55 These terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them shall be governed by and construed in accordance with the law of England & Wales.
56 Each party agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement.
